Please read these Terms & Conditions ("Terms") carefully before using the website operated by GetBER.ie ("us", "we", or "our"). Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms.
1. The Agreement & Acceptance
By accessing, browsing, or using the GetBER.ie website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations of Ireland.
If you do not agree with any part of these Terms, you are not authorized to access the website or use any services provided through it. We reserve the right to amend these Terms at any time without prior notice. Your continued use of the website following any changes constitutes acceptance of those changes.
2. Nature of Our Services
GetBER.ie operates purely as an online intermediary platform. We connect property owners, landlords, tenants, estate agents, and property managers (collectively referred to as "Customers") with independent, third-party SEAI-registered BER assessors ("Assessors").
- No Agency Relationship: GetBER.ie does not employ the Assessors, nor are we partners, joint ventures, or agents of the Assessors.
- Independent Contract: When you book a BER assessment through the platform, the legal contract for the performance of that service is created directly and exclusively between you and the assigned Assessor. GetBER.ie is not a party to that contract.
- Assessor Credentials: While we perform initial verification checks to ensure Assessors possess an active SEAI registration at the time of joining our platform, Customers are advised that ongoing compliance and professional indemnity insurance remain the sole responsibility of the individual Assessor.
3. Quotations, Bookings, & Payments
- Accuracy of Information: All quotations generated by the GetBER.ie instant quote engine rely entirely on the data provided by the Customer (e.g., property type, size, year of construction, location). The Customer warrants that all information supplied is accurate and complete.
- Price Revisions: If the Assessor discovers upon arrival or during review that the property details were materially inaccurate, understated, or incomplete, the quotation will be subject to a price adjustment to reflect the true scope of work required under SEAI guidelines.
- Booking Confirmation: Submitting a request through the website acts as an expression of interest. A booking is only deemed "Confirmed" once the assigned Assessor has formally accepted the job and a date and time slot have been agreed upon by both parties.
- Cancellations & Rescheduling: Customers must provide at least 24 hours' notice for cancellations or rescheduling. Cancellations made less than 24 hours before the agreed appointment may be subject to a late cancellation fee to compensate the Assessor for lost travel time and scheduling.
4. Acceptable Use of the Website
You agree to use GetBER.ie only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the platform. Prohibited behaviour includes, but is not limited to:
- Extracting data from the website using automated systems, scraping software, or bots.
- Submitting fraudulent property details or false booking requests.
- Attempting to interfere with the proper working, security, or infrastructure of the website.
5. Intellectual Property
The website and its original content, features, functionality, logos, design elements, and underlying code are and will remain the exclusive property of GetBER.ie and are protected by Irish and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or modify any part of this site without our express written permission.
6. Limitation of Liability
- Technical Output: GetBER.ie assumes no liability or responsibility for the final BER rating, the technical accuracy of the survey, data entry errors in the SEAI national database, or any accompanying Advisory Report. The Assessor is solely liable for the technical execution of the assessment.
- Platform Availability: We do not guarantee that our website will always be available, uninterrupted, secure, or free from bugs and viruses.
- Exclusion of Damages: To the maximum extent permitted by Irish law, GetBER.ie shall not be liable for any direct, indirect, incidental, special, or consequential damages, losses, or expenses (including loss of profits, business interruption, or delays in property transactions) arising out of or in connection with the use of our website, the quotation engine, or the services booked through it.
7. Indemnity
You agree to indemnify, defend, and hold harmless GetBER.ie, its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, your misuse of the website, or any negligent acts committed during your interactions with an Assessor.
8. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be deleted or modified without affecting the remaining provisions herein.
9. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of Ireland. Any dispute, controversy, or claim arising out of or relating to these terms, including their formation or the breach thereof, shall be subject to the exclusive jurisdiction of the courts of Ireland.
